Why Should You Hire an Attorney?
You may be thinking you do not need an attorney to handle your case, after all, the insurance company has offered you what you think is a fair settlement and you do not want to have to pay an attorney a significant portion of your settlement. Unfortunately it is not that simple. First of all, the insurance company will have several attorneys aggressively representing their interest, which is to pay you as little as possible. Second, you probably have creditors which have a subrogation interest in your settlement or a lien against it. What that means is they will take money from your settlement, even if they might not be legally entitled. What good is a settlement check if you have to give most or all of it to another insurance company? Having your own attorney to represent you means you will minimize your liability to subrogation claims and liens and maximize your total settlement. Most ethical attorneys will also do their best to make sure you get more than the attorney does. Some attorneys will even guarantee that you will get more than the attorney.
